1. Who we are

PromoSplit (PromoSplit, operated by Mariano Marchesoni, Montevideo, Uruguay) runs a marketplace where Sellers list digital products, courses, services and software, and Partners promote them in exchange for a share of the sales they bring.

Contact: hello@promosplit.com. By creating an account or using PromoSplit you accept these terms.

2. What PromoSplit is and is not

PromoSplit is a sales and promotion marketplace. Partners are paid a commission for sales they bring, like an affiliate program.

PromoSplit is not an investment, a fund, a loan or a share in anyone's business. Partners do not own any part of a Seller's business or revenue. Nobody pools money on PromoSplit: each Ad Partner runs and pays for ads in their own ad account and decides their own budget.

We never promise results. Any numbers shown on PromoSplit are past results of other campaigns and do not predict yours.

3. Sellers

Sellers must own or have the right to sell what they list, describe it truthfully, deliver it as described and handle customer support and refunds for it.

Sellers choose the share offered to Partners within the limits PromoSplit sets. A deal accepted by a Partner does not change for that Partner while it lasts; new terms apply only to new promotions.

PromoSplit charges Sellers a platform fee on each sale (currently 5% of the sale price), deducted automatically at checkout. Payment processing fees apply separately.

Sellers may approve or reject ads made by Partners for their products. Ads that wait more than 48 hours for an answer may be approved automatically once they pass our ad review.

4. Partners

Ad Partners connect their own Meta ad account to PromoSplit as a partner with limited permissions (manage campaigns and view performance). They pay their ad costs directly to Meta, set their own budgets and rules, and can pause or stop at any time.

Content Partners promote with their own link and discount code through any lawful channel and invest no money through PromoSplit.

Partners must follow the law and the rules of every platform they use, disclose that they are paid for promotion where the law requires it (for example, with #ad), and never make false claims about a product or promise results to buyers.

Ad spend can be lost. A campaign can bring fewer sales than it costs. You are responsible for the amount you choose to spend.

5. How sales are attributed

A sale is credited to a Partner when it comes through their link, their discount code, or from a customer they brought before (lifetime customer), in that order. Each sale has one owner. Sales that come through none of these belong to the Seller.

Our payment partner may tie a buyer to the first partner who referred them. When that happens, that partner's share is paid by the payment partner and we record it as such.

Our records of sales, fees and shares are final unless you report an error within 30 days with evidence.

6. Payments and refunds

Payments are processed by our payment partner. Partner shares are usually held for about 30 days before payout to cover refunds and disputes. Some shares are paid by transfer from PromoSplit.

To receive payouts, you must verify your identity with our payment partner. This is required by law.

If a sale is refunded or disputed, the related shares and fees are reversed. If a share was already paid, it may be deducted from future payouts.

You are responsible for your own taxes on what you receive.

7. Ads and content rules

Every ad goes through our review and Meta's review. We reject ads that promise income, guarantee results, target personal attributes, use fake urgency or imitate system messages, among others.

If Meta rejects an ad, PromoSplit pauses it everywhere it runs. Repeated rejections can remove a Partner from a product.

8. Accounts, suspension and changes

We may suspend accounts that break these terms, commit fraud (for example, fake purchases, self-referrals or misleading ads) or put other users at risk. Fraudulent sales earn no share.

We may update these terms. We will announce material changes on the site before they apply. Continued use means you accept them.

9. Liability

PromoSplit is provided as is. To the extent the law allows, we are not liable for indirect losses, lost profits, ad spend, or the acts of Sellers, Partners, buyers, Meta or our payment partner. Our total liability is limited to the platform fees you paid us in the 12 months before the claim.

These terms are governed by the laws of Uruguay. Disputes go to the courts of Montevideo, unless the law of your country gives you a right to another forum.
